Terms of Service

These Terms of Service ("Terms") govern your access to and use of velorahub.chat and its services ("Service"), operated by velorahub.chat ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account or using velorahub.chat, you confirm that you are at least 18 years old, have the legal authority to enter into these Terms, and agree to comply with all applicable laws and regulations. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Account Registration

To access the Service you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and not share it with third parties
  • Be solely responsible for all activity that occurs under your account
  • Notify us immediately at support@velorahub.chat if you suspect unauthorized access

We reserve the right to suspend or terminate accounts that provide inaccurate information or violate these Terms.

3. Subscription Plans and Billing

velorahub.chat offers both free and paid subscription plans. By selecting a paid plan:

  • You authorize us to charge your payment method on a recurring basis
  • Subscriptions automatically renew unless cancelled before the renewal date
  • All fees are exclusive of applicable taxes, which you are responsible for
  • We reserve the right to change pricing with 30 days' written notice
  • Payments are processed by Stripe and subject to their terms

Refunds: We offer a 7-day refund policy for new paid subscriptions. After 7 days, fees are non-refundable. Downgrades take effect at the end of the current billing period.

4. Acceptable Use

You agree not to use the Service to:

  • Send spam, unsolicited messages, or engage in mass messaging without consent
  • Violate any applicable law, regulation, or third-party rights
  • Transmit malware, viruses, or any harmful code
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Scrape, crawl, or data-mine the Service without written permission
  • Impersonate any person, organization, or entity
  • Harass, abuse, threaten, or discriminate against any person
  • Use the Service for any illegal or fraudulent activity

Violation of this section may result in immediate account termination without refund.

5. Data and Privacy

Your use of the Service is subject to our Privacy Policy, incorporated into these Terms by reference. You are responsible for obtaining all necessary consents from your end users and contacts whose data is processed through the platform. You represent that your use of customer data complies with all applicable data protection laws, including GDPR and CCPA where applicable.

6. Third-Party Integrations

The Service enables connections to third-party platforms such as Facebook, WhatsApp, and others. Your use of these integrations is subject to the respective third-party's terms of service and policies. We are not responsible for the availability, accuracy, or practices of third-party services. You are solely responsible for maintaining the security of any access tokens or credentials shared with us for integration purposes.

7. Intellectual Property

Our IP: The Service, including its design, code, trademarks, and content, is owned by velorahub.chat and protected by intellectual property laws. Nothing in these Terms grants you ownership of our IP.

Your Content: You retain ownership of all data and content you upload to the Service ("Your Content"). By using the Service, you grant us a limited, non-exclusive license to process Your Content solely to provide the Service to you.

8. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted access to the Service. We may:

  • Perform scheduled maintenance with advance notice where feasible
  • Suspend access in the event of emergencies or security incidents
  • Modify, update, or discontinue features with reasonable notice

We are not liable for any loss or damage resulting from service interruptions.

9. Limitation of Liability

To the maximum extent permitted by law, velorahub.chat and its officers, directors, employees, and agents shall not be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages arising from unauthorized access to or alteration of your data

Our total liability to you for any claim arising from the use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or meet your specific requirements.

11. Termination

Either party may terminate these Terms at any time. You may cancel your account through the Settings page. We may suspend or terminate your access immediately if you violate these Terms or if we reasonably believe your use poses a risk to the platform or other users. Upon termination:

  • Your right to use the Service ceases immediately
  • We will retain your data for 30 days, after which it may be deleted
  • You may request a data export before termination
  • Sections relating to IP, liability, and dispute resolution survive termination

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration, except that either party may seek injunctive relief in a court of competent jurisdiction.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on the platform at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
